1. Introduction

The “My Level Test” Service (hereinafter referred to as the “Service”) is a proprietary offering of UniHouse Global Ltd, registered at Clayton House, 59 Piccadilly, Manchester, United Kingdom, M1 2AQ, and trading under the esteemed name of UniHouse. As a recognized member of the Association of Language Testers in Europe (ALTE), UniHouse Global Ltd consistently strives to uphold and further the benchmarks of language testing and assessment. By engaging with this Service, as well as any other services we might introduce under this brand in the future, you are entering into a binding agreement to comply with these Terms and conditions. Your trust is invaluable to us, and we remain steadfast in our commitment to delivering a service that meets and exceeds global quality standards

2. Eligibility

You must be a minimum age of 18 to register on and use the Service. By registering and using the Service you warrant that you are 18 or older and understand your obligations under these Terms & Conditions.

3. Registration and Account Integrity

3.1 As part of the registration process you will need to create an account, including a username & password. It is your responsibility to ensure that the information you provide is accurate, not misleading, and relates to you. You cannot create an account or username & password using the names and information of another person or using words that are the trademarks or the property of another party (including ours), or vulgar, obscene, or in any other way inappropriate. We reserve the right with or without notice to suspend or terminate any account in breach.

3.2 Where we provide an organisation with a number of user licenses for the Service these must be adhered to. User licenses cannot be shared between users. A breach of this clause will result in the termination of the abused accounts and/or all accounts provided to the organisation.

3.3 If for any reason you suspect that your username & password has been disclosed to or obtained by another party you should contact us immediately.

4. Pricing, Plans and Features

4.1 We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product, service or plan is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any overpayment made by you (as applicable).

4.2 We reserve the right to alter all product, service or plan pricing and features without notice.

5. Payment and Transaction Control

5.1 All services are billed as a one-time payment upon registration for the test.

5.2 Upon upgrading from any promotional offer or trial, you will be immediately charged for the full amount of the My Level Test service.

5.3 The Service payment is made as a singular transaction and does not entail recurring charges.

5.4 It is a condition of use that a valid debit or credit card (or other valid payment methods accepted by us) is provided at the time of the transaction to avail of the Service.

5.5 If a payment request made by us is declined (for any reason), access to the My Level Test may be suspended or denied until a valid payment has been processed.

6. Service Access and Issues

6.1 “My Level Test” service is accessible exclusively online upon successful registration and payment.

6.2 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have rights pertaining to online services. However, as “My Level Test” provides immediate access to the test service, there is no provision for cancellation after the service has been availed.

6.3 Any issues or concerns related to the service should be reported using the facility provided on our platform.

6.4 Reporting concerns through means other than the facility provided, including (but not limited to) email, telephone call, fax, text, or instant message may not be deemed valid.

6.5 In the case of service disruption or defects, we reserve the right to either rectify the issue, offer an additional free test attempt, or issue a partial or full refund at our sole discretion.

6.6 If a refund is deemed appropriate and accepted by you, it will be processed within seven working days from the date of agreement. Once a refund is issued, access to the “My Level Test” service for that specific transaction will be terminated.

7. Refund Policy for “My Level Test”

7.1 All payments related to “My Level Test” are non-refundable once the service has been availed.

7.2 Should any test remain unattempted, partially completed, or become invalidated due to violation of Test Rules or Terms of Service, there will be no provision for refunds.

7.3 However, specific exceptions may apply. If you encounter technical disruptions during the test, or if your results are not delivered within an acceptable timeframe post-test completion (“Test Issue”), we may, at our discretion, offer a refund, credit, or rectify the issue.

7.4 To be eligible for any form of compensation due to a Test Issue, the following criteria must be met:

– Reporting the Test Issue in writing to “My Level Test” within 24 hours of occurrence.

– Providing essential information or cooperation as requested by “My Level Test”.

– Confirming that the Test Issue was not a result of your actions.

– Ensuring strict adherence to all required test protocols and conditions.

7.5 Note: Refunds provided due to a Test Issue will not exceed the initial payment amount for that specific test attempt.

8. Trial and Offer Periods

8.1 Trial or offer periods are offered at our sole discretion and are subject to withdrawal at any time and without notice.

8.2 Where you are offered a free-trial period you will receive an email notification no less than seven days before your free trial-period is due to end offering you the opportunity to convert your free-trial into a paid subscription. Please note this does not apply where you are merely offered a discounted or offer-period paid-for subscription at a reduced rate that subsequently converts to a subscription at one of our full standard subscription rates.

8.3 Only one person may use a single free or trial account, the account cannot be shared amongst multiple individuals.

8.4 These Terms and Conditions apply to all trial or offer-period accounts.

9. Technical Support

9.1 Technical support is provided via email and such other means as we decide in order to provide a proper service to users.

9.2 We reserve the right not to provide a full technical support service to free or trial account users.

10. Specific Service Rules

10.1 As a user you agree not to do any of the following:

1. Abuse, harass, threaten, stalk, defame or in any way seek to violate the rights of another user or third-party.

2. Publish or seek to distribute any material or information that is unlawful, harmful, obscene, indecent, libellous, profane, defamatory, racist, or in any other way inappropriate or objectionable.

3. Use or harvest data provided by other users in a way that they would object to.

4. Encourage illegal activity or activity that violates the rights of other Service users or third parties, whether individuals or organisations.

5. Supply or post content calculated to deliberately mislead other users or third parties, including content falsely made to appear from or be endorsed by us.

6. To pose as another user, third party or organisation employee for the purposes of obtaining user or third-party information.

7. To transmit or transfer any viruses, trojans, worms or any other malicious programs or code intended to spy on, gain control over, disrupt, destroy or in any other way impair any computer hardware or software or any other equipment.

8. Attempt to gain access to our servers or other equipment in order to disrupt, impair, overload, or otherwise hinder or compromise the safety, security, or privacy of any of the services provided by or relied upon by users and us.

9. Reframe or repurpose the Service or any content on it, remove, obscure, or block any notices (and advertising as applicable) provided by us on the Service.

10. Load or provide access to content on the Service or link to other content from the Service, which infringes the trademark, patent, trade secret or any other proprietary right of a third-party or infringes any intellectual property law.

11. Send junk or spam email or emails or posts promoting pyramid schemes, chain letters or any other activity that invites users and others to participate in wasting their time and/or money.

12. Use any robot, spider, scraper, or other technical means to access the Service or any content on the Service.

13. Violate or bypass any Test Rules, nor employ any deceitful methods while attempting the test.

14. Impersonation of another individual during registration or while taking the test is strictly prohibited.

15. Providing inaccurate information or counterfeit documents during registration or test-taking is not allowed.

16. Using multiple accounts to undertake test sessions is forbidden.

17. Modify, tamper with, or present falsified My Level Test results or certificates.

18. Share or present an expired or invalid My Level Test Certificate to any entity or individual.

19. Disclose your My Level Test username and password to any third-party

20. Gather insights about My Level Test’s examination process or to design test preparation materials or a resembling test service.

21. Downloading, copying, distribution, creation of derivative works from, or commercial use of information from the test

22. Access attempts to computer systems or networks related to My Level Test

23. Disable, interfere with, or try to bypass any technological protection or content security measures associated with My Level Test.

24. Engage automated tools, software, or any device that scrapes, extracts, or collects data from My Level Test as is any manual process to the same end.

25. Use My Level Test in an illegal, harassing, unethical, or disruptive manner

10.2 If you breach these Terms & Conditions by sending any unsolicited bulk email, (spam) or any other bulk communications to users your actions will cause harm to us and to the Service. Such harm is difficult to quantify and as such you agree to pay us the sum of £50 for each and every individual email or other communication sent to a user or third-party.

10.3 The above list is not intended to be exhaustive. We reserve the right to remove (with or without notice) any content and suspend or terminate (with or without notice) the account of any user who in our sole judgment is in breach of these Terms and Conditions.

11. Content Ownership

11.1 As a participant, you retain ownership rights to any personal data and specific content you provide outside of the responses given during the test.

11.2 You warrant that any content, excluding test responses, provided by you does not infringe on the rights of a third-party. For content provided during the test (e.g., responses, written samples), My Level Test shall possess all rights. My Level Test reserves the right to use, analyze, and aggregate such response data for the purpose of enhancing the testing experience, improving the platform, research, and other related purposes, ensuring individual data remains anonymous. If any content you provide, outside of test responses, is owned by a third-party or infringes on their rights, you agree to bear all responsibilities, including paying all royalties, fines, and settlements owed to that party, without seeking any contribution from My Level Test.

12. Copyrighted Material

12.1 We do not condone or encourage in any way the posting of copyrighted or proprietary content or information by any users who are not the legal owners of such content.

12.2 Where notified of such breaches by the owner of such content we will remove the content from the Service as soon as practicable. But only where we can reasonably ascertain the true owner of such content.

12.3 If as the owner of such content you believe that your rights have been infringed you should contact us as soon as possible and provide all relevant information in writing.

13. Content Monitoring

Users can freely add content to the Service. We do not monitor or assume any responsibility for content posted onto the Service. If at any time we decide to monitor the Service on any occasion it does not mean that we assume responsibility for removing any content or the conduct of any users at the time or in the future.

14. Termination

14.1 We may terminate your user account and all content and materials associated with it at any time where these Terms & Conditions have been breached. Such termination can be with or without notice. As a user you can choose to terminate your account at any time (subject to any payment plan entered into) and are free to remove any content you have created on termination.

14.2 Various clauses within these Terms & Conditions are designed to survive and continue after termination, including (but not limited to) clauses 11 and 18.

15. Access and Backups

15.1 “My Level Test” employs rigorous measures to ensure that the Service remains accessible and operates correctly at all times. In spite of these efforts, there may be occasions where the Service could be partially or fully unavailable. If the disruption is attributable to failures on our part, we might, where feasible, offer an opportunity for a repeat performance of the Service. If this is not feasible, we may consider offering full or partial refunds, contingent upon the stipulations in clause 17.3.

15.2 Should the Service disruption result from issues caused by a third-party service provider and not directly by us, no refunds will be provided.

15.3 It is incumbent upon you to back up any content or data you introduce to the Service. “My Level Test” emphatically advises users to consistently and comprehensively back up all their content and data related to the Service to avoid any data losses.

15.4 In situations involving power outages, system breakdowns, or other unforeseen disruptions not resulting from our negligence or actions, we are under no obligation to offer a refund or any compensation.

15.5 For the successful administration and integrity of our Service, uninterrupted power and internet connectivity are compulsory. Any complications, system errors, or discrepancies arising due to interruptions in power or the internet are not the responsibility of My Level Test. Test-takers must ensure stable conditions to receive accurate results.

15.6 While we empathize with potential inconveniences resulting from such interruptions, we will not assume responsibility for tests disrupted by these unforeseen circumstances.

15.7 Users encountering Service interruptions are encouraged to promptly report the matter, providing detailed information. Nonetheless, this doesn’t guarantee any form of redress, be it compensation or test continuation.

16. Test Conduct and Guidelines

16.1 Immediate Test Initiation: Upon successful payment, clients are required to begin the test immediately. This information will be prominently displayed on the payment page to ensure the test-taker is prepared to start without delay.

16.2 CEFR Alignment: The results of “My Level Test” align with the Common European Framework of Reference for Languages (CEFR). While they are tailored to correlate directly with UniHouse courses, the results can also serve as a reliable placement test for any general English training courses based on CEFR.

16.3 Continuous Development: “My Level Test” is an evolving assessment tool. We reserve the right to refine, expand, or adjust its content, structure, or methodology as we deem fit to enhance its quality and relevance.

16.4 Authenticity of Information: Test-takers are urged to provide their actual name and the email address where they wish to receive their certificate and report. It’s essential to ensure the authenticity of the participant and the accuracy of the information provided, as these details will be used for official test documentation.

16.5 Receiving Certificates: Certificates and reports will be sent to the provided email address upon test completion. It is the responsibility of the test-taker to ensure the accuracy of this email address.

16.6 After completing the Instant Level Test or any other test at My Level Test, you will be issued a certificate detailing your test results and scores (“Instant Level Test Certificate”). This certificate remains valid for six months from the date of your test. Upon reaching the six-month mark, your My Level Test Certificate will be deemed expired.

16.7 My Level Test services are meticulously crafted based on the Common European Framework of Reference for Languages (CEFR) by a team of language experts. It’s paramount to understand that our test is designed as a placement tool and not as a proficiency examination. While the structure and outcomes are rooted in the CEFR levels, this in no way implies a claim of it being an official proficiency test. Furthermore, although we abide by and base our services on the CEFR standards, we recognize and respect the autonomy of organizations and institutions in their decision-making process. As such, we do not impose or dictate any entity to accept or recognize our test results.

16.8 All “My Level Test” services prioritize creating an environment that champions inclusivity and fairness. Each question devised and integrated into our tests is meticulously reviewed to affirm its adherence to principles that promote equal representation, politeness, and respect. This vetting process is deeply rooted in established regulations and best practices that emphasize an inclusive and unbiased approach. We steadfastly believe that such a diverse and inclusive methodology not only enhances the test-taking experience but also guarantees that every participant, irrespective of their gender or background, encounters a fair and representative testing platform.

16.9 Information on My Level Test Certificates; all certificates issued through “My Level Test” services comprehensively detail the test-taker’s performance and language proficiency. While our certificates do not bear a physical or digital signature, they are generated with a unique identification system to uphold their authenticity. Each certificate contains the following information:

– First name

– Last name

– Name of the test

– Date of issue

– Level on the Common European Framework of Reference for Languages (CEFR)

– Result

– Language Competency

– Recommended UniHouse’s courses

This detailed presentation of information ensures transparency and clarity for both the test taker and any third parties, giving insight into the individual’s language skills as assessed by our test. It is recommended to always refer to the original source of the certificate to confirm its legitimacy.

17. Disclaimer

17.1 We are not responsible for the accuracy of any content on the Service, (except where such Content is provided by us) nor any advertisements placed on the Service.

17.2 We are not responsible for any links to third-party websites from the Service and the inclusion of any link does not imply an endorsement of a third-party website or service by us.

18. Limitation of Liability

18.1 We shall not be liable to you in contract, tort, or otherwise (including negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise for any loss of business, contracts, profits, damage to goodwill or anticipated savings or for any indirect or consequential or loss whatsoever.

18.2 Nothing in this Agreement shall exclude or limit liability for death or personal injury resulting from the negligence of either party or their servants, agents, or employees.

18.3 In any event our liability and that of our employees, officers and third-party partners shall be limited in any 12-month period to the total Service fees incurred by you in relation to the matter subject to the liability or to a payment of £100, whichever is the greater sum.

19. Indemnity

You agree to indemnify and hold us and our subsidiaries, affiliates and partners and their respective officers and employees harmless from any loss, fines, fees, liability, or claim made by any third party arising from your breach of these Terms & Conditions whilst using the Service or any other service provided by us.

20. Privacy

We take your privacy seriously. We are registered under and comply with the Data Protection Act 2018 (UK GDPR) and the General Data Protection Regulation (GDPR). For further details please see our Privacy Policy.

21. Severability

The paragraphs, sub-paragraphs and clauses of these Terms & Conditions shall be read and construed independently of each other. Should any part of these Terms & Conditions or paragraphs, sub-paragraphs or clauses be found invalid it shall not affect the remaining paragraphs, sub-paragraphs, and clauses.

22. Waiver

Failure by us to enforce any accrued rights under these Terms & Conditions is not to be taken as or deemed to be a waiver of those rights unless we acknowledge the waiver in writing.

23. Entire Terms & Conditions

These Terms & Conditions set out the entire agreement and understanding between you and us. We reserve the right to change these Terms & Conditions at any time, on giving reasonable prior notice to you.

24. The Consumer Rights Act 2015

These Terms & Conditions are specifically written in accordance with the Consumer Rights Act 2015. Should these Terms & Conditions conflict with the Act, the Consumer Rights Act 2015 shall prevail and apply.

25. Your Statutory Rights

When acting as a consumer your statutory rights are unaffected.

26. Jurisdiction

These Terms & Conditions shall be interpreted, construed, and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts. Where applicable your statutory rights are unaffected.
